The Kuala Lumpur War Crimes Commission found George W. Bush guilty of war crimes in absentia for the illegal invasion of Iraq.
Kuala Lumpur — It’s official; George W Bush is a war criminal.
In what is the first ever conviction of its kind anywhere in the world, the former US President and seven key members of his administration were yesterday (Fri) found guilty of war crimes.
Bush, Dick Cheney, Donald Rumsfeld and their legal advisers Alberto Gonzales, David Addington, William Haynes, Jay Bybee and John Yoo were tried in absentia in Malaysia.
The trial held in Kuala Lumpur heard harrowing witness accounts from victims of torture who suffered at the hands of US soldiers and contractors in Iraq and Afghanistan.
They included testimony from British man Moazzam Begg, an ex-Guantanamo detainee and Iraqi woman Jameelah Abbas Hameedi who was tortured in the notorious Abu Ghraib prison.
At the end of the week-long hearing, the five-panel tribunal unanimously delivered guilty verdicts against Bush, Cheney, Rumsfeld and their key legal advisors who were all convicted as war criminals for torture and cruel, inhumane and degrading treatment.
Full transcripts of the charges, witness statements and other relevant material will now be sent to the Chief Prosecutor of the International Criminal Court, as well as the United Nations and the Security Council.
The Kuala Lumpur War Crimes Commission is also asking that the names of Bush, Cheney, Rumsfeld, Gonzales, Yoo, Bybee, Addington and Haynes be entered and included in the Commission’s Register of War Criminals for public record.
The tribunal is the initiative of Malaysia’s retired Prime Minister Mahathir Mohamad, who staunchly opposed the American-led invasion of Iraq in 2003.
He sat through the entire hearing as it took personal statements and testimonies of three witnesses namely Abbas Abid, Moazzam Begg and Jameelah Hameedi. The tribunal also heard two other Statutory Declarations of Iraqi citizen Ali Shalal and Rahul Ahmed, another British citizen.
After the guilty verdict reached by five senior judges was delivered, Mahathir Mohamad said: “Powerful countries are getting away with murder.”
War crimes expert and lawyer Francis Boyle, professor of international law at the University of Illinois College of Law in America, was part of the prosecution team.
After the case he said: “This is the first conviction of these people anywhere in the world.”
While the hearing is regarded by some as being purely symbolic, human rights activist Boyle said he was hopeful that Bush and Co could soon find themselves facing similar trials elsewhere in the world.
“We tried three times to get Bush in Canada but were thwarted by the Canadian Government, then we scared Bush out of going to Switzerland. The Spanish attempt failed because of the government there and the same happened in Germany.”
Boyle then referenced the Nuremberg Charter which was used as the format for the tribunal when asked about the credibility of the initiative in Malaysia. He quoted: “Leaders, organizers, instigators and accomplices participating in the formulation or execution of a common plan or conspiracy to commit war crimes are responsible for all acts performed by any person in execution of such a plan.”
The US is subject to customary international law and to the Principles of the Nuremberg Charter said Boyle who also believes the week-long trial was “almost certainly” being monitored closely by both Pentagon and White House officials.
Professor Gurdial Singh Nijar, who headed the prosecution said: “The tribunal was very careful to adhere scrupulously to the regulations drawn up by the Nuremberg courts and the International Criminal Courts”.
He added that he was optimistic the tribunal would be followed up elsewhere in the world where “countries have a duty to try war criminals” and he cited the case of the former Chilean dictator Augustine Pinochet who was arrested in Britain to be extradited to Spain on charges of war crimes.
“Pinochet was only eight years out of his presidency when that happened.”
The Pinochet case was the first time that several European judges applied the principle of universal jurisdiction, declaring themselves competent to judge crimes committed by former heads of state, despite local amnesty laws.
Throughout the week the tribunal was packed with legal experts and law students as witnesses gave testimony and then cross examination by the defence led by lawyer Jason Kay Kit Leon.
The court heard how
- Abbas Abid, a 48-year-old engineer from Fallujah in Iraq had his fingernails removed by pliers.
- Ali Shalal was attached with bare electrical wires and electrocuted and hung from a wall.
- Moazzam Begg was beaten, hooded and put in solitary confinement.
- Jameelah was stripped and humiliated, and was used as a human shield whilst being transported by helicopter.
The witnesses also detailed how they have residual injuries till today.
Moazzam Begg, now working as a director for the London-based human rights group Cageprisoners said he was delighted with the verdict, but added: “When people talk about Nuremberg you have to remember those tried were all prosecuted after the war.
“Right now Guantanamo is still open, people are still being held there and are still being tortured there.”
In response to questions about the difference between the Bush and Obama Administrations, he added: “If President Bush was the President of extra-judicial torture then US President Barak Obama is the President of extra judicial killing through drone strikes. Our work has only just begun.”
The prosecution case rested on proving how the decision-makers at the highest level President Bush, Vice-President Cheney, Secretary of Defence Rumsfeld, aided and abetted by the lawyers and the other commanders and CIA officials – all acted in concert. Torture was systematically applied and became an accepted norm.
According to the prosecution, the testimony of all the witnesses exposed a sustained perpetration of brutal, barbaric, cruel and dehumanising course of conduct against them.
These acts of crimes were applied cumulatively to inflict the worst possible pain and suffering, said lawyers.
The president of the tribunal Tan Sri Dato Lamin bin Haji Mohd Yunus Lamin, found that the prosecution had established beyond a “reasonable doubt that the accused persons, former President George Bush and his co-conspirators engaged in a web of instructions, memos, directives, legal advice and action that established a common plan and purpose, joint enterprise and/or conspiracy to commit the crimes of Torture and War Crimes, including and not limited to a common plan and purpose to commit the following crimes in relation to the “War on Terror” and the wars launched by the U.S. and others in Afghanistan and Iraq.”
President Lamin told a packed courtroom: “As a tribunal of conscience, the Tribunal is fully aware that its verdict is merely declaratory in nature. The tribunal has no power of enforcement, no power to impose any custodial sentence on any one or more of the 8 convicted persons. What we can do, under Article 31 of Chapter VI of Part 2 of the Charter is to recommend to the Kuala Lumpur War Crimes Commission to submit this finding of conviction by the Tribunal, together with a record of these proceedings, to the Chief Prosecutor of the International Criminal Court, as well as the United Nations and the Security Council.
“The Tribunal also recommends to the Kuala Lumpur War Crimes Commission that the names of all the 8 convicted persons be entered and included in the Commission’s Register of War Criminals and be publicised accordingly.
“The Tribunal recommends to the War Crimes Commission to give the widest international publicity to this conviction and grant of reparations, as these are universal crimes for which there is a responsibility upon nations to institute prosecutions if any of these Accused persons may enter their jurisdictions”.
This is indeed a momentous decision, albeit rather symbolic for the time being, as the article points out. It is interesting that the Tribunal has forwarded it’s decision to the International Court. Od course no one would expect it to take action. And the US has exempted itself from recognizing such international indictments. Nonetheless, world opinion will continue to pressure the US to amend its policy of military aggression.
Interesting how US citizenry has begun to harness a voice above the msm. Many of us want Bush&Co tried for war crimes, and appreciate other countries who have followed through with such. The world did not call for help when we went to war in Iraq. In fact, many countries ran the other way, they knew there was no evidence to support an invasion of Iraq. This demotes his status as a civil leader of a democratic country to act outside the law. Yes, other jobs also, need to be put on trial, but the Taliban are not elected leaders of democratic countries and I would not expect them to honor any laws. They are lawless. This “court” was a farce. Malaysia has no jurisdiction over American citizens who have never set foot in that country, and no defense was offered or considered. Under recognized rules of jurisprudence, there has to be an impartial judge in a court of competent jurisdiction, and there has to be defense counsel arguing for the defendent. Until such time as that occurs, you cannot say Bush is guilty of a crime. You can believe so (I believe so), but a belief does not have the force of law. Only a properly conducted trial has the force of law.

This court was convened under the rules of the Geneva Convention.
Every signatory to that convention has a responsibility to convene just such a court.
Now that this court has been convened, the evidence heard and the guilty verdict rendered, all strictly by the book, then yes, I CAN say Bushco are guilty of war crimes.
Further, you have it exactly backward this WAS a properly conducted trial, and it DOES have the force of law.
According to our Constitution, the treaties we sign with other nations have the force of law, and you can be assured that this court followed the law of the Geneva Convention scrupulously within the letter of that law.

Sadly, this trial will indeed be seen only as something symbolic, but I personally wish it would gain acceptance as so much more. But isn’t it interesting that as time goes by we learn more and more tiny details that make the entire event questionable, from the “official” version of what happened? For example, we find that many of the steel structural members show forensic evidence of =demolition= damage, =not= ‘heat’ damage. We also find there was an investigation into $9 TRILLION “missing” from the ‘Federal Reserve Bank’ and all of the records were in Building 9. ALL of those buildings came down WITH Bush`s ASSISTANCE !! He AIDED the terrorists and actually did ten times more damage and loss of life than the terrorists would have done on their own. It think the world would have been a better place had the US not waged a war of aggression against Iraq and the million-plus dead as a result were still alive; the millions of displaced never had to flee their homes; those captured by the occupying forces were never tortured; Iraq’s civilian infrastructure, history, culture, and fabric of society were never obliterated;
violent extremist groups in Iraq and troughout the region (including the Islamic State/ISIS) had not been unleashed; etc.

While the Senate did vote on the original U.N. As for the specific case here – the basis of your book appears to be that Israel and the U.S. have worked to prevent the so-called ‘palestinians’ to be denied self-determination.
Is there a single sentence, a paragraph, a page or a chapter in your book that deals with THE FACT that Jordan controlled the West Bank and Egypt controlled the Gaza Strip, for quite some time in fact, and never once did anyone take the stance against THEIR prevention of self-determination for those living there. Did you point out in your book that it was arabs, not Israel, who actively prevented any chance of ‘palestinian’ self-determination for decades?
And you’re so down on ‘wars of aggression’ – how about THE FACT that arabs have launched multiple wars of aggresssion against Israel? Not high on your list of concerns, I bet.
And what about THE FACT that the U.N. gave ‘palestinians’ the opportunity to form their own country DECADES ago and the ‘palestinians’ rejected it – probably also not presented in your book, at least not honestly.

Bush, Dick Cheney, Donald Rumsfeld and their legal advisers Alberto Gonzales, David Addington, William Haynes, Jay Bybee and John Yoo were tried in absentia in a kangaroo court in Malaysia by people with no valid right or reason to do so and no authority whatsoever. The outcome of the ‘trial’ was assured before it even began.
The farce was the idea of Mahathir Mohamad, who is best known for his destruction of the independence of Malaysia’s judiciary and his implementation of the Internal Security Act, which resulted in the inappropriate detention of activists, non-mainstream religious figures, and political opponents. His record of curbing civil liberties and his antagonism to western interests and economic policy made his relationships with the United States, United Kingdom, and Australia, among others, difficult. It is fairly clear this ridiculous exercise in futility is his way of getting back at the U.S. for whatever it is he still is upset about that happened decades ago.
Francis Boyle, the closest thing to a legal scholar involved, admitted that this action was purely symbolic. One wonders when he will check into a psychiatric hospital for treatment of his continuing Bush Derangement Syndrome.
Before the kangaroo court even got properly underway, Jason Kay Kit Leon revealed that at least one of the Judges was biased and had no business taking part, but since it was essentially a mock trial, they ignored him and proceeded.
Not mentioned was the fact Malaysia had no jurisdiction and no basis for convening this action.

After Donald Rumsfeld testified on the Hill about Abu Ghraib in May, there was talk of more photos and video in the Pentagon’s custody more horrific than anything made public so far. “If these are released to the public, obviously it’s going to make matters worse,” Rumsfeld said. Since then, the Washington Post has disclosed some new details and images of abuse at the prison. But if Seymour Hersh is right, it all gets much worse.
Hersh gave a speech last week to the ACLU making the charge that children were sodomized in front of women in the prison, and the Pentagon has tape of it. The speech was first reported in a New York Sun story last week, which was in turn posted on Jim Romenesko’s media blog, and now EdCone.com and other blogs are linking to the video. We transcribed the critical section here (it starts at about 1:31:00 into the ACLU video.) At the start of the transcript here, you can see how Hersh was struggling over what he should say:
“Debating about it, ummm … Some of the worst things that happened you don’t know about, okay? Videos, um, there are women there. Comments made in wake of US-backed proxy regime’s fall in Thailand further alienate the waning superpower.
First in Hong Kong, now in Thailand, ongoing US plans to install proxy regimes to extend hegemony across Asia-Pacific have fallen into disarray.
The latest row comes after US Assistant Secretary of State for East Asian and Pacific Affairs Daniel Russel made comments condemning the recent coup that first deposed, then saw the impeachment of ex-Thai prime minister Yingluck Shinawatra over a vast array of corruption and abuse of power charges.
Russel was quoted by an official US State Department transcript of a speech he gave in Thailand as saying:
…a narrow, restricted process – carries the risk of leaving many Thai citizens feeling that they’ve been excluded from the political process.
That’s the reason why we continue to advocate for a broader and more inclusive political process that allows all sectors of society to feel represented, to feel that their voices are being heard. I’d add that the perception of fairness is also extremely important and although this is being pretty blunt, when an elected leader is removed from office, is deposed, then impeached by the authorities – the same authorities that conducted the coup – and then when a political leader is targeted with criminal charges at a time when the basic democratic processes and institutions in the country are interrupted, the international community is going to be left with the impression that these steps could in fact be politically driven.
Russel’s comments about “Thai citizens feeling that they’ve been excluded” is the preamble Shinawatra’s own political front often uses to justify acts of terrorism and armed insurrection that have left hundreds of people dead. It is also a familiar line used to justify engineered US-backed violence in other nations aimed at regime change.
Russel’s claims that Shinawatra’s criminal charges were “politically driven” beg belief. For the US to defend a prime minister openly serving as a proxy for a convicted criminal hiding abroad, and who presided over a regime that recklessly destroyed the economy while literally murdering its political opponents in the streets, is a clear breach of diplomatic protocol and unbecoming of the alleged purpose of the US State Department itself.
Indeed, the US State Department exists to represent the will of the American people abroad, not to impose it upon others.
The Thai government quickly condemned the comments, and a large public backlash followed, aimed at what is now increasingly seen as direct US meddling in Thailand’s internal affairs.
What the US Sees in the Shinawatras
Yingluck Shinawatra came to power in 2011, running openly as a proxy for her brother, Thaksin Shinawatra, a convicted criminal who fled abroad to evade a 2 year jail sentence as well as a myriad of other pending criminal court cases. The election motto for Thaksin Shinawatra’s “Peua Thai” political party was literally, “Thaksin Thinks, Peua Thai Does,” an overt admission that a convicted criminal is still, quite literally attempting to rule the country.
To explain why the US has breached diplomatic protocol, and is targeting Thailand’s national sovereignty by meddling in its internal affairs, it must be noted that Thaksin Shinawatra himself has been a long-time family friend of the Bush political dynasty, was a member of the Carlyle Group, and since being ousted from power himself in a similar military coup in 2006, has been openly represented by some of the largest corporate lobbying firms on Earth, including, Kenneth Adelman of the Edelman PR firm (Freedom House, International Crisis Group,PNAC), James Baker of Baker Botts (CFR, Carlyle Group), Robert Blackwill (CFR) of Barbour Griffith & Rogers (BGR), Kobre & Kim, Bell Pottinger (and here) and currently Robert Amsterdam of Amsterdam & Partners (Chatham House).
While in office Shinawatra took up a decidedly pro-US stance, economically and geopolitically. To the protest of the Royal Thai Army and the Thai people themselves, Shinawatra sent Thai troops to aid in the illegal invasion and occupation of Iraq. He also authorized the US CIA to use Thai territory to carry out their abhorrent “rendition” program. Shinawatra also attempted to ram-rod through an unpopular and quite illegal free trade agreement with America’s Fortune 500.
Also during his time in office, Shinawatra committed a series of atrocities against the Thai people themselves. First, in 2003 he initiated what he called a “war on drugs.” Nearly 3,000 were extrajudicially murdered in the streets over the course of just 90 days. It would later turn out that more than half of those killed had nothing at all to do with the drug trade. In this act alone, Thaksin became the single worst human rights offender in Thai history. The following year, he would violently put down protests in Thailand’s troubled southern provinces killing 85 people in a single day, now known as the “Tak Bai incident.”In addition to these two notorious atrocities, according to Amnesty International, 18 human rights defenders were either assassinated or disappeared during his first term in office. Among them was human rights activist and lawyer Somchai Neelapaijit. He was last seen in 2004 being arrested by police and never seen or heard from again.
Shinawatra also conducted a campaign of terror and murder against his opponents. In April of 2009 gunmen would fire over 100 rounds into the vehicle of anti-Shinawatra activist, protest leader, and media mogul Sondhi Limthongkul in a broad daylight assassination attempt. He was injured but survived. On April 10, 2010, heavily armed professional militants deployed by Thaksin Shianwatra and his “red shirt” front targeted and assassinated Colonel Romklao Thuwatham who was at the time commanding crowd control operations near Bangkok’s Democracy Monument. Thaksin’s “red shirts” would go on to clash with the military for weeks before ending their riot with mass city-wide looting and arson. And in August of 2013, businessman and outspoken Thaksin opponent Ekkayuth Anchanbutr was abducted and murdered.
For those familiar with the true nature of US foreign policy, the US buttressing a brutal but obedient dictator is an all too familiar tale, one that continues today with the US State Department openly working to undermine the legitimacy of the current Thai government and its efforts to fully uproot the Shinawatra regime along with the US-backed networks of sedition that helped Shinawatra retain its tight grip on the levers of Thai political power for over a decade.
That this grip appears to have been loosened, indicates that America’s ability to interfere with impunity has diminished.
Russel’s comments were not made to a receptive Thai public – most of whom welcomed the military coup deposing the Shinawatra regime. Even in 2011, a meager 35% of Thailand’s total electorate voted for Shinawatra’s party, and of those who bothered to vote, Peua Thai failed to earn the popular majority. According to an Asia Foundation poll conducted in 2010, a mere 7% of Thailand’s 70 million citizens, identified themselves strongly as “red,” the color associated with Shinawatra’s political front.
The myth that the military overthrew a “popularly elected democratic government” could not be any further from the truth – and such myths have only gained traction thanks to the enormous and continuing support Shinawatra and the networks supporting his political power receive from the West’s immense media monopolies.
Despite these monopolies, the backlash Russel’s comments have earned both himself and the United States’ agenda in Thailand is disastrous. No longer do many Thais see the current political crisis as merely a battle between Thaksin Shinawatra and Thailand’s traditional political order, but instead, as an existential battle against a foreign agenda that has created and to this day continues to prop up Shinawatra and a vast network aimed at overturning both Thailand’s existing political order, and its sovereignty in the process.

NEED MORE DIRECT REFERENCES :: CHECK THE FACTS :: he European Center for Constitutional and Human Rights has filed a criminal complaint against U.S. torture program architects and members of the Bush Administration. The organization has accused CIA director George Tenet and Defense Secretary Donald Rumsfeld of war crimes and they’ve called for a German prosecutor to conduct an immediate investigation.
This move follows the release of the damning Senate report on CIA torture that includes the case of German citizen Khalid El-Masri, who was captured in 2004 by CIA agents in a case of mistaken identity. The report revealed the shocking contrast of democracy and corruption.
Bizarrely, the only person involved with the CIA torture program who has been charged with a crime is the man who exposed the war crimes — whistleblower John Kiriakou.
The relevant parties in this case have given an extensive interview to Democracy Now. Some of the important points are below.
Wolfgang Kaleck, the general secretary of the European Center for Constitutional and Human Rights and the author of International Prosecution of Human Rights Crimes said this:
“By investigating members of the Bush administration, Germany can help to ensure that those responsible for abduction, abuse and illegal detention do not go unpunished.”
Michael Ratner, president emeritus of the Center for Constitutional Rights and chairman of the European Center for Constitutional and Human Rights said this:
“I strongly disagree that Bush, Cheney, et al., would have a defense. This wasn’t like these memos just appeared independently from the Justice Department. These memos were facilitated by the very people — Cheney, etc. — who we believe should be indicted. This was part of a conspiracy so they could get away with torture. But that’s not the subject here now.”
“Secondly, whatever we think of those memos, they’re of uselessness in Europe. Europe doesn’t accept this, quote, ‘golden shield’ of a legal defense. Either it’s torture or it’s not. Either you did it or you didn’t. Comments made in wake of US-backed proxy regime’s fall in Thailand further alienate the waning superpower.
First in Hong Kong, now in Thailand, ongoing US plans to install proxy regimes to extend hegemony across Asia-Pacific have fallen into disarray.
The latest row comes after US Assistant Secretary of State for East Asian and Pacific Affairs Daniel Russel made comments condemning the recent coup that first deposed, then saw the impeachment of ex-Thai prime minister Yingluck Shinawatra over a vast array of corruption and abuse of power charges.
Russel was quoted by an official US State Department transcript of a speech he gave in Thailand as saying:
…a narrow, restricted process – carries the risk of leaving many Thai citizens feeling that they’ve been excluded from the political process.
That’s the reason why we continue to advocate for a broader and more inclusive political process that allows all sectors of society to feel represented, to feel that their voices are being heard. I’d add that the perception of fairness is also extremely important and although this is being pretty blunt, when an elected leader is removed from office, is deposed, then impeached by the authorities – the same authorities that conducted the coup – and then when a political leader is targeted with criminal charges at a time when the basic democratic processes and institutions in the country are interrupted, the international community is going to be left with the impression that these steps could in fact be politically driven.
Russel’s comments about “Thai citizens feeling that they’ve been excluded” is the preamble Shinawatra’s own political front often uses to justify acts of terrorism and armed insurrection that have left hundreds of people dead. It is also a familiar line used to justify engineered US-backed violence in other nations aimed at regime change.
Russel’s claims that Shinawatra’s criminal charges were “politically driven” beg belief. For the US to defend a prime minister openly serving as a proxy for a convicted criminal hiding abroad, and who presided over a regime that recklessly destroyed the economy while literally murdering its political opponents in the streets, is a clear breach of diplomatic protocol and unbecoming of the alleged purpose of the US State Department itself.
Indeed, the US State Department exists to represent the will of the American people abroad, not to impose it upon others.
The Thai government quickly condemned the comments, and a large public backlash followed, aimed at what is now increasingly seen as direct US meddling in Thailand’s internal affairs.
What the US Sees in the Shinawatras
Yingluck Shinawatra came to power in 2011, running openly as a proxy for her brother, Thaksin Shinawatra, a convicted criminal who fled abroad to evade a 2 year jail sentence as well as a myriad of other pending criminal court cases. The election motto for Thaksin Shinawatra’s “Peua Thai” political party was literally, “Thaksin Thinks, Peua Thai Does,” an overt admission that a convicted criminal is still, quite literally attempting to rule the country.
To explain why the US has breached diplomatic protocol, and is targeting Thailand’s national sovereignty by meddling in its internal affairs, it must be noted that Thaksin Shinawatra himself has been a long-time family friend of the Bush political dynasty, was a member of the Carlyle Group, and since being ousted from power himself in a similar military coup in 2006, has been openly represented by some of the largest corporate lobbying firms on Earth, including, Kenneth Adelman of the Edelman PR firm (Freedom House, International Crisis Group,PNAC), James Baker of Baker Botts (CFR, Carlyle Group), Robert Blackwill (CFR) of Barbour Griffith & Rogers (BGR), Kobre & Kim, Bell Pottinger (and here) and currently Robert Amsterdam of Amsterdam & Partners (Chatham House).
While in office Shinawatra took up a decidedly pro-US stance, economically and geopolitically. To the protest of the Royal Thai Army and the Thai people themselves, Shinawatra sent Thai troops to aid in the illegal invasion and occupation of Iraq. He also authorized the US CIA to use Thai territory to carry out their abhorrent “rendition” program. Shinawatra also attempted to ram-rod through an unpopular and quite illegal free trade agreement with America’s Fortune 500.
Also during his time in office, Shinawatra committed a series of atrocities against the Thai people themselves. First, in 2003 he initiated what he called a “war on drugs.” Nearly 3,000 were extrajudicially murdered in the streets over the course of just 90 days. It would later turn out that more than half of those killed had nothing at all to do with the drug trade. In this act alone, Thaksin became the single worst human rights offender in Thai history. The following year, he would violently put down protests in Thailand’s troubled southern provinces killing 85 people in a single day, now known as the “Tak Bai incident.”In addition to these two notorious atrocities, according to Amnesty International, 18 human rights defenders were either assassinated or disappeared during his first term in office. Among them was human rights activist and lawyer Somchai Neelapaijit. He was last seen in 2004 being arrested by police and never seen or heard from again.
Shinawatra also conducted a campaign of terror and murder against his opponents. In April of 2009 gunmen would fire over 100 rounds into the vehicle of anti-Shinawatra activist, protest leader, and media mogul Sondhi Limthongkul in a broad daylight assassination attempt. He was injured but survived. On April 10, 2010, heavily armed professional militants deployed by Thaksin Shianwatra and his “red shirt” front targeted and assassinated Colonel Romklao Thuwatham who was at the time commanding crowd control operations near Bangkok’s Democracy Monument. Thaksin’s “red shirts” would go on to clash with the military for weeks before ending their riot with mass city-wide looting and arson. And in August of 2013, businessman and outspoken Thaksin opponent Ekkayuth Anchanbutr was abducted and murdered.
For those familiar with the true nature of US foreign policy, the US buttressing a brutal but obedient dictator is an all too familiar tale, one that continues today with the US State Department openly working to undermine the legitimacy of the current Thai government and its efforts to fully uproot the Shinawatra regime along with the US-backed networks of sedition that helped Shinawatra retain its tight grip on the levers of Thai political power for over a decade.
That this grip appears to have been loosened, indicates that America’s ability to interfere with impunity has diminished.
Russel’s comments were not made to a receptive Thai public – most of whom welcomed the military coup deposing the Shinawatra regime. Even in 2011, a meager 35% of Thailand’s total electorate voted for Shinawatra’s party, and of those who bothered to vote, Peua Thai failed to earn the popular majority. According to an Asia Foundation poll conducted in 2010, a mere 7% of Thailand’s 70 million citizens, identified themselves strongly as “red,” the color associated with Shinawatra’s political front.
The myth that the military overthrew a “popularly elected democratic government” could not be any further from the truth – and such myths have only gained traction thanks to the enormous and continuing support Shinawatra and the networks supporting his political power receive from the West’s immense media monopolies.
Despite these monopolies, the backlash Russel’s comments have earned both himself and the United States’ agenda in Thailand is disastrous. No longer do many Thais see the current political crisis as merely a battle between Thaksin Shinawatra and Thailand’s traditional political order, but instead, as an existential battle against a foreign agenda that has created and to this day continues to prop up Shinawatra and a vast network aimed at overturning both Thailand’s existing political order, and its sovereignty in the process.

What’s the problem? Ridley never said there was a trial but a tribunal, initiated by the former PM. Bush and Cheny were found guilty by a panel of senior judges – this is clear. The accusers were victims of torture. This is clear. the findings are being sent to the WCC as evidence. This is clear. The detractors here are blowing smoke.
Upon further perusal of the comments below I am struck by the lack of comment on the topic of the story itself. It seems to me many of the comments are actually a joke to the intelligence. Give it up guys, you get paid for this?

Why not explore a few facts about the trial and events leading up to it.
First of all, Iraq is a Muslim nation, so is Malaysia. What else can one expect other than a guilty verdict?
Second, there were 5 witnesses. If the crimes were so widely spread, more than 5 witnesses would have come forward or called along with affidavits and other sworn statements. At least in the Nazi trials, mountains and mountains of evidence was presented.
Third, the “trial” was held in 2012, almost 10 years after the invasion of Iraq. Again, it was held in Malaysia, an Islamic country.
Fourth, not one of us was sitting in the chair in the Oval Office and not one of us is or was privy to the intelligence available at the time.
Fifth, the intelligence that was available ended up being unreliable but that was not known at the time. In fact, for several years prior to 9/11, whenever possible and a microphone was available, Democrats (Hillary, Kerry, and several others) made public declarations that they knew Saddam Hussein did still have WMDs. As late as 2003, Bill Clinton made a public comment that when he left office, he knew for sure Saddam Hussein did possess WMDs. Plus as an added bonus, Clinton made it official policy for regime change in Iraq. He was the one who signed the policy that Saddam Hussein had to go.
Sixth, this was a nation that went through the senseless slaughter of 3,000 civilians by a group of terrorists and Americans by a vast majority were demanding something had to be done.
Seventh, Saddam Hussein purposely misled the world about his WMD capabilities and nuclear ambitions. He used it as propaganda and to maintain his hold on Iraq.
Eighth, the men and women serving on the carrier were the ones who erected the banner not because of the Iraq mission but it was for the completion of their own mission. Bush was referring to the completion of the war effort to overthrow Saddam Hussein. He acknowledged the effort to rebuild Iraq had just started.
Ninth, it was the mishandling of the post war administration of Iraq that spawned the resistance and yes, for that, Bush is responsible along with the Iraqi administrator, Bremer. His handling of the situation was ham-handed and totally ignorant of post war history when it comes to rebuilding a defeated nation. Consider Japan and Germany after WWII. Both were handled correctly for the most part and today, both are allies and strong trading partners with America.
Tenth, not one of us who criticize was in Bush’s position on and after 9/11. 20/20 hindsight is always perfect and after the dust settles and unintended consequences are revealed, it is then when the critics and perfectionists come out of the woodwork to vilify and find fault.
It is easy to sit behind our keyboards and post comments about Bush, Obama, Clinton, and any other leader we may or may not agree with. It is easy to sit in judgement after the fact, isn’t it? The purposeful overthrow of Quadaffi in Libya by the Obama administration has produced chaos, strife, and anarchy, yet, the press and Bush critics have remained very silent. Libya is not mentioned at all but it is a hotbed of terrorism and supporters of terrorists still today.
If anyone has any common sense and is willing to use it instead of pointing fingers, they will understand that what we are witnessing now in the ME did not start with Bush but had its beginnings decades ago. Starting with Theodore Roosevelt on to Obama, the ME has always been a problem area and it will continue to be one. It is a waste of time to blame Carter, Reagan, Bush, Clinton, Bush II, or Obama as the sole source of the problems in the ME. Humans are not infallible and history proves it over and over and over and over, ad infinitum, ad nauseum.
HAHAHAHA!!!!! Freakin brilliant!!! Why on Earth would these people actually think anybody gives a ripe SHIT what they think? Third, the Security Council can’t do SHIT to the permanent SC members. Fourth, America isn’t a signatory of the International Criminal Court, and is therefore immune to that body’s jurisdiction. FIFTH, nobody but a bunch of meaningless third-world countries could care less what these people think.

Why did this “poorly” written article never get traction? Bush and company mentioned are criminals. Do the trolls out number the rules of Law? Even if you could say it was poorly written. Which it is not. The press had enough information to fact check and bring the truth to the public. Criminals in my opinion should be exposed and brought to justice. In this case to dismiss the Malaysian court as insignificant. That in and of itself is a crime. The justice system works on the principle that it is not the accused that is on trial. It is the law that is on trial. For the courts to dismiss this fact is a slide down hill and we are accepting ourselves as a lawless Nation. In America one person shoots a theater of people . Anyone who has read anything about torture by the US and knows anything about the Nuremberg Trials knows that “the moral leader of the free world” in 1945 descended into depravity in late 2001, 2002 and thereafter. The Commander in Chief demeaned soldiers who followed his orders, had them dishonorably discharged, prosecuted and imprisoned, throwing loyal soldiers under the bus to save his own skin. We also know the only protection any US POW has is knowing that the country he or she is serving “does not torture” and George Bush lied. We’ve known for a long time who the “bad apples” were, those named in the trial. The Constitution, the Geneva Conventions and the Convention Against Torture require every lawful nation to prosecute those suspected of authorizing, aiding, abetting or having any part of torture to be prosecuted. We are no longer a lawful nation under a Constitution until some honest, patriotic American prosecutor, judge, member of Congress or officer who took at oath to defend the Constitution press for prosecution of those named and others who obstructed justice by destroying records and lying under oath. Bush and Cheney publicly confessed they had authorized torture and boasted that they would do it again to save lives. That’s what the Nazis said, “to save lives, to save their country.” We hanged them anyway.

Unfortunately, as Malaysia is not one of the 120 member states that constitute the International Court of Criminal Justice (Rome Statute, 1998) , that this has been ruled in Malaysia, or that the report shall be sent to the Chief Prosecutor of the ICC will have no bearing or significant influence over matters whatsoever. In international law terms, at best , this ruling might help increase awareness if circulated enough..

I say the United States should pull out of every country unless they are willing to pay for our help. I think we should not be the world’s police force and we have sent too many of our men and women in harms way. First, may I say that I and many other Americans would like to see W and the rest of these hooligans cuffed up and flown to the Hague for an initial criminal investigation. We would likely add some names, Richard Perl comes to mind, but also others. Second, I think that many commentators are too graciously forgiving of my fellow citizens. Recall, although it was very close, they re-elected “War Crimes”,, as I have referred to him for many years. On the night of the invasion, I had conversations with a friend. It was obvious there was no justification for this invasion. There was no crime, much less threat, to the US. The so-called Weapons of Mass Destruction had been said to be a non-existent by members of our own inspection teams, who had gone into Iraq with UN for years. One does not invade a sovereign nation with foreseeable destruction of all its infrastructure, unknown toll to civilians, with no clear provocation. It was also obvious, and we observed between us at the time, of course, obviously, the most powerful army to ever exist on earth would make very quick work of the Iraqi forces, no problem. But what then? Anyone in the US who is able to read a newspaper knew, long long ago, Iraq is three springs or coils held under high tension by the dictator, Sadaam. The three coils we know, Suni shiite kerds, with kerds least engaged. Remove Sadaam, and ?????????? Bush was so stupic. If he just waited, with an embargo, no fly zones, wait and watch. At some time, surely, some Iraqis would rise up and take him. Army probably. Let his own people depose him. But no, he now has dragged the name of America in dirt and mud, stained us with the blood of innocent people, made worse relations between Muslim, Christian, Jew, and created the monster ISIS. Good work W. Bush we viewed as an ignorant fool, the paragon example of an American cowboy, six guns, smile, no brain, no plan, no idea, he did not really hate foreign people. Rather, he was ignorant of anything, and stupidly convinced, if something is American, then it is better than anything else. Universal Jurisdiction is not international law, according to the International Court of Justice (Belgium v. The Congo). Under international rulings, only convened international courts or U.S. courts have jurisdiction. Considering the partisan nature of this tribunal, any neutral observer would conclude that such prosecution would be politically motivated and voided in international courts.
